Agreement

By using the CallConX service, you agree to be bound by Brindley Data Services terms & conditions set out below.

In the following terms & conditions, the words CallConX are used to refer to Brindley Data Services “CallConX Hosted PBX package”.

CallConX is a telephony service which utilises an internet connection to make and receive telephone calls. Various services are included. which are the provision of a dedicated telephone number of your choice, outbound calling, inclusive call plan as stated as well as an array of advanced telephony features, for example mobile phone twinning and international calling add-ons.

Fair Usage Policy

A Fair Usage policy applies for CallConX packages with inclusive monthly minutes

‘Unlimited’ is bound to a maximum of 2000 UK landline minutes and 2000 UK mobile minutes per extension per month, if this number is exceeded, you will be charged the standard rate for all minutes used, including the 2000 bundled minutes, see rate card for standard rates. 

If you are expecting to make a significant number of calls, this restriction can be mitigated by purchasing additional extensions in order to benefit from the additional pooled minutes that these extension subscriptions will bring.

Multiple subscriptions will have pooled access to these minutes, for example 2 extensions will share 4000 minutes per month to UK landlines and 4000 minutes per month to UK mobiles, allowing one extension to use 3000 minutes so long as the other uses less than 1000.

VOIP Calling

Calls to UK landlines (01, 02, 03) and UK mobiles are free as detailed in the CallConX package. An RRP amount equal to £20 is included within this package to call other numbers including non-geographic (NGN’s), international and premium rate numbers. Once this allowance is used additional “credit” can be purchased if required and are charged as per our rate card.

Emergency Calls

Emergency calls (999 or 112) are available with the CallConX service once customers have registered a mainland UK address, excluding users located in the Isle of Man or Channel Islands.

Contract period

A minimum contract period of 12 months is applicable to all your CallConX services from the time it is activated.

At 11 months of service you will be contacted to remind you that you have one month left to renew your service to ensure continuity of service. It is your responsibility to positively affirm you wish to continue with the service and settle the following years fee in full. After the minimum contract period, your service will terminate automatically. If you choose not to renew, no notice is required. 

Customers wishing to cancel their CallConX service at any time should email a cancellation request to support@callconx.co.uk

In the event that the contract is subject to distance selling regulation, where service starts within seven days of purchase, rights of cancellation will end upon commencement of service.

Billing

You will receive one invoice/receipt of payment via email for your subscription. Brindley Data Services reserves the right to cancel your subscription if payment is not received.

Each time you make an ad-hoc payment to top-up your International/premium rate numbers credit account you will be sent an invoice/receipt of payment within 3 days of your payment clearing. 

Invoices can only be queried retrospectively up to 3 months. 

Brindley Data Services has the right to close/block CallConX accounts that we suspect to be fraudulent and proof of identification may be requested to verify users.

Service Cancellation

Cancellation of the service requires no notice period but must be stated in writing for our records. Upon receipt of this cancellation advice, your account will be terminated immediately without penalty or fees. Any number supplied by CallConX will be cancelled also unless an agreement is reached in advance to port the number, and the costs of doing so are settled in advance. 

No refunds will be given in regard to your service should you decide to cancel.

Processing, Shipping & Returning Orders

Brindley Data Services aims to ship all items within 48 hours of receiving the order but the order may be delayed if the item is received out of standard working hours or the item is not in stock.  Please note we are not always able to supply dates when the stock is next available. 

Credit and debit cards are debited before items are shipped by Brindley Data Services. All prices include sales taxes (where applicable) unless otherwise stated.

If an item is not in stock at the time you place an order, customers may cancel the order at this stage if they wish to do so. We will reimburse any payment customers have made in respect of that order.

Full refunds are only available on items that are returned within seven days.  Goods are to be in brand new condition and be in their original packaging. Full details of our shipping and returns policy can be found on our website http://www.callconx.co.uk/returns_policy.

Modification of Terms

Brindley Data Services reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the CallConX website. These terms & conditions will apply to your order once you have received your confirmation email and will supercede any other terms & conditions. Please print and retain a copy of the terms & conditions once you have received your confirmation email.

Limitation of Liability

This liability section applies only to the extent permitted by law.

User agrees to indemnify, defend and hold Brindley Data Services, its affiliates, directors, officers, employees, agents and licensors harmless from and against any and all claims, actions, expenses, losses, and liabilities (including court costs and reasonable legal fees), arising from or relating to this agreement including user's access to and use of the CallConX service to the maximum extent permitted by applicable law, in no event shall Brindley Data Services or any of its licensors, be liable for any indirect, special, punitive, exemplary, or consequential damages arising out of the access to or use of or inability to access or use the CallConX service, or that result from mistakes, omissions, interruptions, deletions of files, errors, defects, delays in transmission or operation or any failure of performance, even if advised of the possibility of such damages.

IMPORTANT INFORMATION / Essential Service Information

This is a voice over data network service and as such, it is dependent on your connection to the data network and the data network itself. Your service may therefore cease to function if there is a power failure or a failure in the underlying data network. 

Confirmation by accepting the terms of use, you (hereinafter the 'user') are stating that you agree to accept and be bound by all of the terms & conditions of this agreement. 

Do not proceed if you are unable to agree to the terms and conditions of this agreement. 

These terms and conditions of service for use of the CallConX service (the 'agreement') constitutes a legally binding contract between Brindley Data Services and the entity that agrees to and accepts these terms & conditions. Access to the CallConX service is being provided on an 'as is' and 'as available' basis. Brindley Data Services makes no representations or warranties of any kind, whether expressed or implied, with respect to user access of the CallConX service, including but not limited to the warranties of merchantability, non-infringement, title or fitness for a particular purpose. 

Further, Brindley Data Services makes no representations or warranties that the CallConX service or user access thereto, will be available at any given time, or will be free from errors, defects, omissions, inaccuracies, failures or delays in delivery of data. User assumes, and Brindley Data Services disclaim, total risk, responsibility, and liability for user access to and use of the CallConX Service.

Access to the CallConX service is being provided on a non-exclusive basis. User acknowledges and understands that CallConX is a platform which is subject to ongoing development and that Brindley Data Services makes no guarantees regarding the availability or functionality thereof. User may not sublicense its access rights to the sip server to any third party.

You accept email as a valid means of communication of any agreement between you and Brindley Data Services. It is your responsibility to check that the details of your confirmation email are correct and that you keep a copy for your records. This confirmation email amounts to an acceptance by Brindley Data Services or third party supplier that is engaged on your behalf by Brindley Data Services.

CallConX services are free to be withdrawn from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods, any description applied to the goods, the availability of the goods or the order itself.
